GENERAL CONDITIONS OF SALE AND USE

ARTICLE 1. SCOPE

The general conditions of sale detailed below (hereinafter referred to as the "General Conditions") govern the contractual relationship between any user of the histoireaumur.com site (hereinafter referred to as "User" or "You") and the brand. commercial UNE HISROITE AU MUR* belonging to the company UNE HISTOIRE AU MUR* SAS with a capital of 1,000 euros, whose head office is located at 1 place du Louvre - 75001 Paris and registered with the Paris Trade and Companies Register under the number ##### (hereinafter referred to as "A STORY ON THE WALL").

These general conditions of sale are the only ones applicable and replace all other conditions, except prior, express and written derogation.
UNE HISTOIRE AU MUR may occasionally be required to modify some of the provisions of its general conditions, so it is necessary that they be reread before each visit to the histoireaumur.com site (hereinafter referred to as the "Site").
These modifications are enforceable from the time they are put online (07/01/2023) and cannot be applied to contracts concluded previously. Each purchase on the Site is governed by the general conditions applicable on the date of the order.

These artistic creations are the expression of the authors' creativity.

The prices of our products are indicated in euros all taxes included (VAT + other taxes) excluding the purchaser's participation in processing and shipping costs.
In the event of an order to a country other than metropolitan France, you are the importer of the product(s) concerned.
Customs duties or other local taxes or import duties or state taxes may be payable.
These rights and sums are not the responsibility of UNE HISTOIRE AU MUR. They will be at your expense and are your sole responsibility, both in terms of declarations and payment to the competent authorities and/or bodies in your country. It is essential to inform yourself beforehand about these particular aspects with the competent authorities.
UNE HISTOIRE AU MUR* reserves the right to modify its prices at any time. The products will be invoiced on the basis of the rates in effect at the time of the order entry, subject to availability.
The products remain the property of UNE HISTOIRE AU MUR* until full payment of the price indicated.

2. Order
To place an order, you must at least go through the following steps:
• Consultation of the sheet presenting the product. You must click "Add to Cart" to add this item to your cart.
• “Basket” screen: you can view the list of selected creations and delete an item or modify the quantities ordered at any time.
• Screens for identifying or creating a customer account.
• Delivery mode selection screen. On this screen you will be offered a link to modify the items in your order.
• Summary screen and choice of payment. This screen allows you to choose your method of payment and check the various elements making up your order (items, quantities, delivery method, total price). The conditions are available for reading and printing from the link entitled "general conditions of sale". Their acceptance is made by ticking the box affixed to the proposed link. The general conditions of sale and use of the Site must be accepted with each order.
• You pay for your order by the means of payment chosen from those indicated.
• The contract is only concluded upon confirmation of payment by the bank.
• The Site sends you an order confirmation to your e-mail within minutes.

3. Means of payment
Payment for your purchases is made:
- either by credit card: Visa, MasterCard
- Either by bank check (orders from France only; the check must be issued by a bank domiciled in metropolitan France).

4. Payment Security
For payments by credit card, the transaction is carried out by Ogone, via the Crédit Mutuel payment system, on the Crédit Mutuel website.
The User's bank details are encrypted (SSL technology, Secure Socket Layer).
They do not circulate unencrypted on the internet.
Your bank details (card number, expiry date) are in no way communicated to UNE HISTOIRE AU MUR

5. Evidence
The data recorded by the Site constitutes proof of all transactions between the Site and its customers.
The data recorded by the Crédit Mutuel payment system constitutes the one and only admissible proof of the financial transactions carried out.

6. Processing and delivery of orders
Orders, placed from Monday to Friday excluding public holidays, are dispatched within 48 hours subject to the production time for certain products. Works marked "OUT OF STOCK" can no longer be ordered.

7. Delivery address
A HISTORY ON THE WALL* delivers in mainland France, in the countries of the European Union and in all countries insured by the carrier Colissimo.

The products are delivered to the delivery address that you indicate during the ordering process, this address may be different from the so-called billing address. The delivery deadline is dependent on and corresponds to:
- at the shipping time indicated on the item sheet,
to which is necessarily added
- the processing and delivery time.
Changing the delivery address after placing the order is in principle no longer possible for logistical reasons.
However, you can contact us by email or telephone if you wish to change your delivery address, we will then study the possibilities offered according to your order.

8. Delivery methods and deadlines
The possible delivery methods depend on the quantity, the size of the item(s) ordered and the country of delivery.
If your order includes items of different sizes, the size of the largest item is taken into account.
A STORY ON THE WALL* reserves the right to choose the carrier.
Compliance with delivery times depends on the carrier. Consequently, no claim for compensation, of any nature whatsoever, may be invoked or claimed by the customer.

9. Shipping costs
Shipping costs vary depending on the country and the delivery method as well as the number and format of the works ordered.

10. Receipt of delivery
Upon receipt of your order, it is up to you to open the package to see that the prints are in good condition.
If you do not personally receive the package, ask the person in charge of receiving the package to carry out this check.
In the event of a problem, please return your package to the delivery person (La Poste or private carrier) stating the problem encountered and contact our customer service the same day.
Do not sign the delivery slip if the order arrived damaged. No claim will be admissible if the delivery note has been signed.
In the case of a delivery by private carrier, the carrier is not required to deliver inside your home and can give you the package at the entrance of your building or house.
Receipt of the items transported extinguishes any action against the carrier for damage or partial loss if within three days, not including public holidays, which follow that of this receipt, the recipient has not notified the carrier, by extrajudicial act or by registered letter, his protest which must be substantiated. (Art L 133.3 of the Commercial Code).

11. Right of withdrawal
In accordance with the legal provisions in force, you have as an individual a general right of withdrawal to return the work that does not suit you. This right does not apply to orders placed by companies.

For any order on the Site, you have a period of 14 days from the date of receipt of the said order to exercise your right of withdrawal from UNE HISTOIRE AU MUR*, without having to justify any reason or to pay a penalty.

To do this, please contact our customer service who will give you the return address and you will then have 10 days to return your order to us in its original packaging.

• If your order was delivered by post (Colissimo), you can return your order to us by post (return costs at your expense).
• If your order was delivered by a carrier, the latter will pick up your order. This service will be billed to you at the same price as the initial delivery charges.
No shipment against reimbursement will be accepted, whatever the reason.

UNE HISTOIRE AU MUR* will reimburse you the price of the returned items as well as the initial shipping costs minus the penalties (the return costs remain your responsibility) within 15 days of receipt by it, by credit made on the bank account used for payment, or by bank check or gift voucher depending on the method of payment then used when ordering.

12. Right of return
In the event that the works received do not conform to the order, you have a right of return. In this case, please contact our customer service who will tell you the address and the return procedures.
UNE HISTOIRE AU MUR* will exchange the damaged item, within the limit of available stocks.
In the case of the exercise of the right of return and only in this case, the costs of return and new sending remain the responsibility of UNE HISTOIRE AU MUR*.

13. Customer service and complaints

ARTICLE 3. FORCE MAJEURE

The products offered comply with the French legislation in force.

In the event of a dispute, only the French courts will be competent to be seized.
